Terms of Service
Effective date: June 17, 2026
These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”, or “Customer”) and the owner and operator of houses360.com (collectively “Houses360”, “we”, “us”, or “our”). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Houses360 provides a software-as-a-service platform that lets users create, host, brand, and share interactive 360° virtual property tours, capture leads, manage agent and brokerage branding, and embed tours on third-party websites (the “Service”). We may add, change, or discontinue features at any time. We will provide reasonable notice for material changes that adversely affect a paid plan.
2. Eligibility
You must be at least 18 years old and able to form a binding contract under applicable law to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.
3. Accounts & Security
You must provide accurate and current information when registering and keep it up to date. You are responsible for safeguarding your password and any activity that occurs under your account. You will notify us immediately at support@houses360.com of any unauthorized use. We may suspend or terminate accounts that contain false information, are inactive for extended periods, or violate these Terms.
4. Plans, Trials & Billing
Houses360 offers a Free plan with limited capacity and several paid plans (Starter, Pro, Business, and Reseller). Current pricing and plan limits are available on the Pricing page. Paid plans are billed in advance on a monthly basis through our payment processor, Stripe.
- Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current rate until cancelled. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis.
- Cancellation. You may cancel at any time from the in-app billing portal. Cancellation takes effect at the end of the current billing period; you will retain access to paid features through that date.
- Refunds. Except where required by applicable law, fees are non-refundable. We do not provide refunds or credits for partial billing periods, downgrades, or unused time on an active subscription.
- Failed payments. If a payment fails, your subscription may enter a past-due state and access to paid features may be suspended until payment is brought current. Persistent failure to pay may result in termination.
- Price changes. We may change subscription pricing on at least 30 days’ notice (by email and/or in-app). Changes take effect at your next renewal.
- Taxes. Fees do not include taxes. You are responsible for all applicable sales, use, value-added, and similar taxes, except taxes on our net income.
5. Your Content
“Your Content” means any panoramas, photos, video, floor plans, documents, property descriptions, branding assets, contact details, leads, and other materials you upload, submit, or transmit through the Service.
Ownership. You retain all right, title, and interest in and to Your Content. We do not claim ownership of any content you upload.
License to Houses360. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, modify (e.g., resize and generate thumbnails), display, and distribute Your Content solely as necessary to operate, secure, and improve the Service and to provide it to you and to people you choose to share tours with.
Your representations. You represent and warrant that (a) you own Your Content or have all rights, licenses, consents, and permissions necessary to upload and use it on the Service; (b) Your Content does not infringe any copyright, trademark, privacy, publicity, or other right of any third party; (c) Your Content complies with all applicable laws and real-estate licensing rules in your jurisdiction; and (d) you have obtained all consents required from individuals who appear in or are referenced by Your Content.
Lead and visitor data. When visitors submit lead forms or interact with your tours, you become responsible for the privacy, lawful use, and security of that information, including compliance with applicable real-estate, do-not-call, anti-spam, and data-protection laws (including GDPR and CCPA/CPRA where applicable).
6. Houses360’s Intellectual Property
The Service, including its software, design, user interface, documentation, brand, logos, and related materials, is owned by Houses360 or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purpose during your subscription. All rights not expressly granted are reserved.
7. Acceptable Use
You agree not to, and not to permit or encourage others to:
- Upload, share, or distribute content that is unlawful, defamatory, obscene, harassing, discriminatory, fraudulent, or that infringes intellectual property or privacy rights;
- List or market properties you are not authorized to represent, or misrepresent property facts in violation of fair-housing or real-estate licensing laws;
- Use the Service to send unsolicited commercial communications, spam, or chain messages;
- Probe, scan, attack, reverse-engineer, decompile, or otherwise attempt to discover source code, except as expressly permitted by law;
- Bypass or interfere with rate limits, authentication, billing, or other technical controls; share login credentials; or operate more accounts than your plan allows;
- Use the Service to host or distribute malware, run a denial-of-service attack, or harvest user data via scraping or automated means;
- Resell, sublicense, or white-label the Service to third parties without our written consent.
We may, in our sole discretion and without prior notice, remove content, suspend accounts, or block access for actual or suspected violations.
8. Public Tours, Embeds & Public URLs
By publishing a tour you make Your Content publicly accessible at a Houses360 URL (including friendly slugs, permanent ID URLs, and short share codes) and may allow third parties to embed it on other websites. You are responsible for the legality of publishing each tour and may mark a tour as private or password-protected at any time.
9. Teams & Multi-User Plans
On plans that support teams, the account owner (the “Team Owner”) is responsible for adding, removing, and supervising team members, and for ensuring that team members agree to and comply with these Terms. Tours, content, and billing for the team are consolidated under the Team Owner’s account.
10. Email & SMS Communications
We will send you transactional messages required to operate your account (verification, password reset, billing receipts, lead notifications, tour activity). You may also receive product update messages, which you can opt out of. By providing a phone number for SMS notifications, you consent to receive automated text messages and acknowledge that standard message and data rates may apply.
11. Third-Party Services
The Service integrates with third-party providers, including but not limited to Stripe (payments), our hosting provider, mapping providers, and font/CDN providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
13. Copyright Complaints (DMCA)
We respect intellectual property rights and respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act. Please send DMCA notices to dmca@houses360.com with: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location on the Service; (d) your contact information; (e) a statement of good-faith belief that use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights-holder. We may remove allegedly infringing content and terminate repeat infringers.
14. Suspension & Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for actual or suspected violations of these Terms, fraud, abuse, security incidents, non-payment, or where we are required to do so by law.
Upon termination: (a) your right to use the Service immediately ceases; (b) we may delete Your Content and account data after a reasonable grace period (typically 30 days); (c) sections of these Terms that by their nature should survive termination — including ownership, indemnification, disclaimers, limitation of liability, and dispute resolution — will survive.
15. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, that defects will be corrected, or that the Service will meet your requirements.
Houses360 is a tool for displaying property information; it does not verify property listings, ownership, MLS data, agent licensure, or transaction outcomes. You are solely responsible for the accuracy and legality of all property and agent information you publish.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOUSES360, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
17. Indemnification
You will defend, indemnify, and hold harmless Houses360 and its affiliates, officers, employees, and agents from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right, including intellectual property, privacy, or publicity rights.
18. Governing Law & Dispute Resolution
These Terms are governed by applicable U.S. federal law and the state law identified by Houses360's operator in its production business records, without regard to conflict-of-laws principles. Subject to the arbitration clause below, disputes not subject to arbitration will be brought in a court with proper jurisdiction over Houses360's operator.
Binding arbitration. Except for claims for injunctive relief or claims that qualify for small-claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator’s award may be entered in any court of competent jurisdiction.
Class action waiver. You and Houses360 each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative action.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice at least 30 days before the changes take effect. By continuing to use the Service after the effective date, you accept the updated Terms. If you do not agree, you must stop using the Service before the effective date.
20. Miscellaneous
- Entire agreement. These Terms (together with the Privacy Policy and any order forms) are the entire agreement between you and Houses360 regarding the Service and supersede prior agreements on that subject.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver. Failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delay or failure to perform caused by events beyond reasonable control.
- Notices. Notices to you may be sent to the email address on your account; notices to us must be sent to legal@houses360.com.
- Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
